PT NKE has been demanded to pay Rp. 188.7 M And It Is Also Prohibited To Follow Auctions

The Public Prosecutor (JPU) of the KPK sued PT Nusa Konstruksi Enjiniring Tbk (NKE), previously named PT Duta Graha Indah Tbk (DGI), with a fine of Rp1 billion and paying a replacement money of Rp188.7 billion. This corporation is called legally and convincingly guilty of committing a criminal act of corruption.


"Stating that PT Nusa Konstruksi Enjiniring Tbk is proven legally and convincingly guilty of committing corruption as in the first indictment," said KPK JPU Lie Putra Setiawan, at the Jakarta Corruption Court (Tipikir), Thursday (11/22).


"Imposing the criminal against the defendant with a fine of Rp1 billion," the Prosecutor continued.


If within one month after the decision is legally enforceable, PT NKE does not pay a fine, the property will be confiscated and auctioned to cover the fine.


"If within a period of one month after the decision of the court of law is valid, the Defendant will not pay the said fine, then his property will be confiscated by the Prosecutor and auctioned off to cover the fine," the Prosecutor said.


In addition, PT NKE is required to pay a replacement fee of Rp188,732,756,416 (Rp.88.7 billion) as an additional penalty.


"Dropping an additional criminal sentence against the defendant to pay a replacement money of Rp188,732 billion," Prosecutor Lie said.


In addition to substitute money, the additional penalty for PT NKE was also the revocation of the right to take part in a two-year government project auction. "Imposing an additional sentence in the form of revoking the defendant's right to take part in a government project auction for 2 years," the Prosecutor added.


It is known, PT NKE was the first company to be dragged into a defendant by the KPK. As a corporate representative, sitting in the defendant's chair is PT NKE's President Director Djoko Eko Suprastowo.


At the indictment hearing on Thursday (11/10), PT NKE was charged with enriching its own corporation worth Rp240.098 billion through eight projects obtained from former Democratic Party politician Muhammad Nazaruddin.


PT NKE was charged with violating Article 2 paragraph (1) jo. Article 18 of the Corruption Eradication Act jo. Article 55 paragraph (1) 1st and Article 64 paragraph (1) of the Criminal Code (KUHP).
